TERMS OF USE

Please read these Terms of Use carefully, as they govern your access to and use of EuroMedClinic services.

By using EuroMedClinic, including this website (the “Platform”, “We”, “Us”, “Our”), you fully accept and agree to be bound by these Terms of Use, together with any other rules, policies, and procedures published on the Platform (collectively, the “Terms”).
If you do not agree with any part of these Terms, you must not use the Platform and should cancel any active bookings.


1. General Provisions

  • The EuroMedClinic Platform provides access to both online and offline medical services within the European Union (EU), the European Economic Area (EEA), and Switzerland.
  • Online consultations are conducted via secure video, chat, or messaging tools, while offline (in-person) consultations take place at the registered medical offices or clinics of participating physicians.
  • Users located outside the EU/EEA/Switzerland are not permitted to receive medical consultations through the Platform.
  • Any attempt to use the Platform from outside the EU/EEA/Switzerland — including through the use of VPN or similar technologies — will be considered a violation of these Terms and may be reported to the relevant authorities.
  • The Platform is governed by the laws of the Federal Republic of Germany, and any disputes shall be exclusively resolved in the courts of Germany.

2. Nature of Services

  • EuroMedClinic acts solely as a technological intermediary between clients and independent licensed medical professionals.
  • The Platform itself does not provide medical advice, diagnosis, or treatment.
  • All medical consultations — whether conducted online or offline — are the sole responsibility of the individual licensed physician providing the service.
  • The Platform may facilitate booking, payment processing, and communication between clients and physicians but bears no responsibility for the professional conduct or outcomes of medical consultations.
  • You acknowledge that any medical advice or treatment received through the Platform is undertaken at your own risk.

3. Geographic Scope

  • The Platform operates and is legally available throughout the European Union (EU), the European Economic Area (EEA), and Switzerland.
  • Any consultation, medical certificate, or prescription issued via the Platform is valid only within these jurisdictions.
  • Practicing physicians may only consult or treat patients — whether online or offline — in countries where such services are legally permitted under national law.
  • Offline (in-person) consultations must comply with the local healthcare regulations and licensing laws of the country where the physician practices.

4. Emergencies

DO NOT USE THE PLATFORM IN EMERGENCY SITUATIONS.
EuroMedClinic is not intended for emergency care and does not monitor or respond to urgent medical requests.

In case of a medical emergency, you must call the local emergency number (112) or go to the nearest emergency department or hospital immediately.

Platform personnel or physicians reserve the right to contact emergency services on your behalf if they reasonably believe you are in immediate danger.


5. Legal Compliance

EuroMedClinic complies with:

  • all applicable European Union and national telemedicine and healthcare regulations;
  • the General Data Protection Regulation (GDPR);
  • and all relevant privacy, consumer protection, and medical licensing laws within the EU/EEA/Switzerland.

All consultations, both online and offline, are conducted in accordance with the laws of the country where the consulting physician is legally registered and authorized to practice.


6. Payment and Booking

  • All payments are securely processed through Stripe or other authorized payment systems.
  • Valid payment details must be provided at the time of booking.
  • Fees for medical services are determined individually by each participating physician.
  • The Platform does not store full credit or debit card data.
  • In-person (offline) visits must also be booked and paid for through the Platform when applicable.

7. Prescriptions and Medical Records

  • Physicians on the Platform may issue private prescriptions only where permitted by national and EU law.
  • Controlled or restricted substances may not be prescribed through the Platform.
  • Prescriptions are valid only within the EU/EEA and Switzerland.
  • You may voluntarily upload your medical records before or during a consultation to assist the physician, but this is entirely optional.

8. Account and Security

  • To use the Platform, you must create an account and provide accurate personal details (full name, date of birth, gender, mobile number, email, and password).
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Only one user account is permitted per person.
  • You may not share, sell, or transfer your account to others.
  • Unauthorized access, spam, hacking, or data collection without consent is strictly prohibited.

9. Intellectual Property

  • All content on the Platform — including text, design, graphics, and trademarks — is protected by copyright and intellectual property laws.
  • You may use the Platform only for personal, non-commercial purposes.
  • Copying, modifying, distributing, or reselling Platform content without prior written permission is prohibited.

10. Limitation of Liability

EuroMedClinic and its affiliates are not liable for:

  • any direct or indirect damages arising from the use or inability to use the Platform;
  • any medical advice, treatment, or outcome provided by independent physicians;
  • any loss of data, interruption, or technical malfunction;
  • any actions or omissions of third parties, including pharmacies or clinics.

The Platform’s total liability, if any, shall be limited to the amount paid by the user for the consultation.


11. Data Protection and Privacy

All personal data is collected, processed, and stored in full compliance with the General Data Protection Regulation (GDPR) and EuroMedClinic’s Privacy Policy.
You consent to the processing of your data for the purpose of providing telemedicine and administrative services, including booking and payment.


12. Final Notice

EuroMedClinic operates under the jurisdiction of the European Union and Germany.
By using this Platform, you confirm that you are physically located within the EU, EEA, or Switzerland, and that you understand and accept the legal restrictions on telemedicine and medical services outside these territories.
Both online and offline consultations are subject to these Terms and to the applicable laws of the respective countries of practice.
